This is an extract from the Terms of Use document and is specifically related to
the Adventure Shop system.
Range
The Site contains facilities for browsing and/or purchasing products of
various nature. The range of products may change at any time with new items and
categories of product being added or deleted as determined by I.T.
Beyond. Most items in the Adventure Shop are sourced from other manufacturers
and I.T. Beyond is, as such, a retailer.
Stock
Most items in the Adventure Shop are held in stock by I.T. Beyond, however
some items are stocked and shipped by the supplier direct to the consumer.
Stock held by I.T. Beyond and shipped by ExplorOz
Stockist information is displayed for each item.
For items stocked and shipped by ExplorOz the words "Shipped from
ExplorOz" will appear in the boxed description in the lower right
hand corner.
Stock Supplied on Order and shipped by ExplorOz
Some items may only be available on order and will be shipped by
ExplorOz. For these items there will be some delay to enable us to raise
the order on the supplier. We have only offered this service on items from
suppliers that have an established overnight courier service with us. I.T.
Beyond is not responsible for any internal stocking delays that restrict
the item from being sent on the overnight service from the supplier to
I.T. Beyond. Shipping from ExplorOz to consumer will be as displayed in
the Shopping Cart based on your selected Freight Option.
If stock is not available, I.T. Beyond will not be held responsible for
any delays although we have established the fastest methods possible for
restocking and most orders can be filled within 1 week.
Stock held by Supplier and shipped by Supplier
For items not shipped from ExplorOz, the supplier has agreed to deliver
direct to consumer. We have only offered this service where the supplier
has agreed to use their own arrangements for freight/postage. I.T. Beyond is not responsible for the delivery,
although any enquiries or concerns can be directed to us for follow-up
with the supplier.
Postage and packaging charges are paid by the consumer and are
calculated in accordance with Australia Post postage rules. The combined
cost is called "Freight" and is itemised separately for each
order.
The consumer selects the postage service within the shopping cart
screen and the relevant charges are displayed. Depending on the delivery
address, there may be various options for postal services with the number
of days of delivery displayed for each selection. Note - the delivery time
does not include time for payment clearance and is only activated from the
day order processing begins.
If a Registered or Express Service is not selected, then I.T. Beyond is
not responsible for any loss of goods during shipping. Cover for loss of
goods is only given in accordance with Australia Post Terms and Conditions
for Registered and Express Post services.
Undeliverable Mail - it is the consumer's responsibility to
provide a correct delivery address in the order. If an order is returned
undeliverable because of insufficient address details then the consumer
must pay the postage charge to have the parcel redelivered correctly.
Damaged Goods - goods are sent in first class condition and all
care is taken to adequately package items. No responsibility is taken by
I.T. Beyond for any damage that may occur during transit through the
Australia Post service although all care is taken.
Payment
Any person throughout the world may purchase items from the ExplorOz
Adventure Shop and payment is not restricted to credit card - we accept
VISA, MASTERCARD, BANKCARD, and AMERICAN EXPRESS plus Direct Deposits, Cheques, Money
Orders.
After
selecting the items from the shop they will be added to your Shopping
Cart. To purchase the cart you need to click on the Order Cart option as explained below.
The Order Cart button will direct your browser onto a secure server to capture your delivery information.. This server is secured
via the use of SSL encryption. SSL (Secure Socket Layer) uses a U.S.
Military encryption code, which changes during each access and jumbles the
data making it un-readable to hackers. This process ensures that as the
data is sent through the net, so no one can read it. An SSL internet
connection is confirmed when you see the small "padlock" icon in
the status line of your browser. After entering your delivery details and based
on your payment selection you will either be directed to the National Secure Internet
Payment Service for credit card processing or presented with an order confirmation
containing the information you need to complete the order payment.
Order Processing
After the payment screen is completed by the consumer, the system will send back a
confirmation of the order to the email address supplied in the order
process. I.T. Beyond is not responsible for contacting consumers by any other
means if the email fails due to an incorrect address being supplied by you
in the order. No response is required to the confirmation report and order
processing will begin. Our system will automatically send email
notifications to advise the following stages of your order completion:
Order Received, Payment Received, Order Shipped (including notification of
back-ordered items).
No order will be processed until payment has been received.
- All credit card transactions are checked for bank authorisation
before order packing.
- Cheques, money orders and Direct Deposits must be received and
cleared before order packing.
The email address you provide is used to issue order status
notifications throughout the processing, including the issue of a Tax
Invoice. This is sent as email as an HTML message. A print out of the
invoice can be packed in your order, however this is not done unless
requested.
Credit Card Transactions
The ExplorOz Adventure Shop uses the Merchant Name of I.T. Beyond Pty
Ltd and by purchasing from the Adventure Shop you acknowledge that the
transaction will appear on your statement as I.T. Beyond Pty Ltd.
I.T. Beyond uses National Internet Payment Service and transactions are processed
in real time however order checking and fulfilment will only occur during business hours on the day the order is
received (Australian Western Standard Time).
Back Orders
Orders are usually shipped completed, however if an item is not in
stock and is holding up delivery of your order we may send it with a back
order report. Back orders are not a common occurrence and only occur due
to supplier back orders (ie. an order has not arrived due to an internal
delay with the supplier). In this instance I.T. Beyond is not liable and
is not required to compensate for the delay in any way.
Changes to Order
Unless you alert us instantly that a change is required to your order
you accept that a transaction on your credit card to the value of the
confirmed order may be made. If the transaction has already been made but
shipment of your order has not occurred then you may contact us to advise
the required change. A second order confirmation will be sent to confirm
the changes and either a second debit or a refund will be transacted on
your credit card.
If your order has already been shipped then the situation will be
assessed independently by the Directors of I.T. Beyond Pty Ltd and is
subject to our Returns Policy.
Returns
Goods are shipped on "Firm Sale" and are not subject to
returns based on change of mind or unsuitability. In extreme cases where
an incorrect selection of goods has been made, the consumer may request a
return of the goods for a refund of the invoiced product value less a a
re-stocking fee of 15%. Returns will be refused where the item is no
longer stocked by I.T. Beyond, or has been superseded by a new edition.
All requests for return must be made within 31 days of original purchase
and be accompanied by proof of purchase (order ID is acceptable, eg.
EOShop#). Refunds will only be given on items returned in first class
condition and posted to I.T. Beyond Pty at PO Box 967 Hillarys WA 6923 at
the expense of the consumer.
CD-Roms, DVD's and Tape products cannot be returned or exchanged unless
the product is faulty, defective or otherwise required by law.
Goods damaged in transit are not covered by our carrier, Australia Post
and cannot be returned for replacement. See Postage and
Packaging.
