Well well well......Craig is refusing to return car to us and consumer affairs has been contacted with written details being sent off tonight!

Just a quik update for you all......fingers crossed hey! The joys of living in a smallish town - word travels really quickly and it has already started.

Isn't this a good thing?? Surely if he is refusing to give it back to you it must mean he wants to give you your money back? Otherwise, he's stealing!!!!

yeah its a good thing and a bad thing, he was suppose to return car to us on Mondy or Tuesday. He has just said on the phone (after this was posted) that he will look into getting it back either 2mrw or next week. He is refusing to give it to us because its not fixed butthe mech's had it for over 3 wks.
He told me on the phone that mechanic swiped the computer clean when he got it and started fresh with it. Spoke to mechanic today and he hasnt swiped the puter and thoght it funny that there was no fault on it.......obviously Craig has swiped it to make us look like the idiots.....and so he can come to us and say there is no fault.....

Did the Patrol go back to Craig with the engine light on? The computers in the Patrols are funny things. With mine I had a number of issues and returned it many times but there was no engine light on so no fault code. On other occassions I had the engine light on and a fault code which related to turbo pressure problems but the dealer un plugged the device, the light went out and he said "see how it goes". Well eventually it goes "BANG".
Funny now, but at the time!!!!!!!!!!!!
So having no fault code does not mean that nothing is wrong with the vehicle, it just makes it hard to diagnose. Having a fault code makes it easier to find the area where the fault is but then you need to put your trust in someone to rectify the fault.
Anyway at least Craig seems to be trying to help out. I think originally you were hoping for an exchange and perhaps he will honour this but all car sales people I have met, except for one, have been pretty slippery "professionals" and are great at promising the world and delivering nothing. Keep us imformed.

Firstly he tells you he can't give it back to you cos it's not fixed; then he seems to be telling you there is no fault ......

I know you said at the start of all this drama that he is a mate of yours etc, but money has been known to ruin friendships before. I get the impression he's about to wipe you like a dirty ar-se......

Good luck and keep the pressure up.

I'd be trying to get into the Cruiser that you have spoken about if I were you......

He has been lying through his teeth at us about whats been going on, so yeah, go figure! But fair trading is now in on it so we'll see how that goes.

we tried him on the cruiser today and he said no way, its worth more than the patrol (apparently! and according to him!), told him to go jump, he offered us the petrol one but he's had that in the yard for 7 weeks....Ive been counting!

We'll just see Roachie, but he doesnt realise that I fight back! (and Nath!)

AJB.....we would have and we would have had it at the mechanc with the light on but verytime its come on we have either lost power and had to restart or its been out of trading hrs....once by 15 minutes and the mechanic didnt want a bar of it....
Will keep ya posted...he has been good until today, now we wont hold back!

Hi Laura

If this Craig, doesn't come good with the Money for some reason,
most probably he will say he has exhausted all avenues trying to
honour the warranty, and ex amount of mechanics can't find a
fault with the vehicle, just make sure you get an extended warranty
to cover that particular fault, if it occurs again in the near future,
seems like the whole deal is going Pear Shape, very tricky situation
to be in, good luck.

It sounds to me like he has bent over backwards to try & help, if the vehicle is subject to a statuatory warranty, remember that any time that the vehicle has been out of your possession for warranty work, is added to the warranty period.

Well you wanted your money back so ask him for it if he wont give car back.

As he has to pay GST etc he wont want to refund full amount expecially after how many months?????????

Its been since the last week of June...so whats that....5 months...he can go jump for losing money, so have we, ruined a good trip, put 12 months rego on it....had a car that we cannt trust and rely on....

The refund of the GST component is no issue.
The dealer will simply claim the adjustment back on his next BAS and get it returned from the ATO (Or offset)

Me thinks that the dealer has been piddling in your pocket all the time. If he had bent over backwards, then the vehicle should have been sent to Nissan Headquarters, for them to check out, not just some mechanic, "personally known by the dealer to be good".


I do not think he knows just what sort of an animal he has fired up !

Radical treatment needed.

Maybe you should let him and Nissan finish talking crap to you, then park the patrol, out in front of his place, with flashing lights, the local paper, and TV cameras, and just turn away customers for 1 - 2 weeks..
When you are done do the same to Nissan Headquarters, they are renowned for nor honouring warranties.

Interesting point Daz.
