Ever wondered how far a defect notice goes?

Just thought I'd post this as a bit of information for everyone running something borderline legal on their car...

My workmate drives a grey import twin turbo celica (obviously this type of car attracts the police attention somewhat) and he came into work this morning after being pulled over and defected (in heavy traffic mind you) by the police yesterday afternoon.

There were many things listed on the defect notice as you can imagine with a car of this nature, however one stuck out when I looked at it that had me shaking my head:

Defected for not having H pattern on manual gear stick lever.

Just shows if they have you in their sights they will ALWAYS find something!

One of the 'lads' got done here. Same story- but one of the items was "No tyre specification placard" ...
I think the car is a Commodore..& the placard is actually in the glovebox lid..The kid didn't know about it- but neither did the Plod...

Thanks for that. He can be proud to join a lot of others who have got 'caught'.

My 74 beetle is illegal, since it has it on the dash, not the gear stick.

And the button fell off the top of my 78 golf gear stick.

Of course what they would find on the rest of these cars if they got serious would also be interesting.

Remember once being in a friends bright red charger (E37 from memory) and being pulled over. We were on the side of the road for over an hour, 2 police cars, 4 police bikes, and after a full drug search, having all of the seats, carpets etc out, and a full machinery check, could only get him on a load exhaust with just a hot dog muffler.

We had to put everything back too, which took another 1/2 hour.

Must have been quiet that Sunday night.

I keep my cars looking stock these days, easier that way.

Did you ask Mr Plod to write out a summons, and see him " in court "
If a magistrate seen that he would laugh at it, unless he was Mr Plod's brother in Law ,,

I do not accept that all the stories are " all the innocent party ", if you give Mr Plod a mouthfull, sure he will go thru you ,,
If you go to an area that is considered a " hot-spot " and do some " crusing " then he will go thru ..

When I was a " kid " I had Mr Plod, pull me over, because I had wide tyres,,Now this was in the 1970, ( a year either side dosen't matter )
I just let him go and he was having a ball,, this that,, talking get the tow-truck blah, blah, blah.....
Then when he was about to go and give me the ticket, with all the defects, I just reached into the glove-box and brought out a 2 day old roadworthy certificate ,,
That shut him down, but I was not game to do anything wrong in town for the next 2 years,, and basically thats all Mr Plod wanted anyway ,,

Cheers Mate

In my book a loud exhaust is good for a few years in gaol but I will forgive you the typo/spell error.

what a load of crap eh..........what would they do for an auto if the lights didnt come

based on the above ..all cars would and must be illegal....

can any one point me to any car having a steering wheel which is marked with a shape descriging a "siren" or "horn" is present
That is utter bull.....i'd be asking them to prove why it is illegal for not having H. If for some reason they can, ADR's etc etc i would have them in court in front of magistrate judge or whoever arguing it out and citing all cars must be illegal for not having a switch marked with a siren/horn indicating that the vehicle is fitted with an approved ADR warning device.

"can any one point me to any car having a steering wheel which is marked with a shape descriging a "siren" or "horn" is present "

Holden Frontera. Just underneath the emblem in the centre of the steering wheel.

Knowing a few highway coppers & hearing a few story's from the other side you soon find out that some of these minor roadworthy items are brought on themselves after they fail the "attitude test". That is those who try to bullsheet the officer, tell lies, abuse them or use their position (eg Doctor) to get out of a ticket. I pass the attitude test by being polite, having my licence out ready, admitting to exactly what I've done & on all occations have had the fine reduced to a lesser infringement. If you aren't in there sights they wont need to find something :-)

You just got it in 1 , treat the "plod" the way you would like to be treated and you find that they are only human doing a job with some of the harshest rules and restrictions applied to themselves , with the amount of lies and B/S they have to listen to every day is it any wonder that they become cynical.

If your vehicle is illegal (unroadworthy) it SHOULDN'T be on the road. Simple as that. No pity.

If you look hard enough most vehicles would be unroadworthy.
But I'm sure you have never driven an unroadworthy car!!

not sure about other states but my understanding for nsw is that only coppers with an RTA certificate can legally defect your car for anything other than bald tyres and lights not working or broken. anything else technically needs a qualified inspector to verify the condition and roadworthyness of your car..
if you want to argue the point , ask for his certificate. most coppers don't know squat about cars. of course you may end up being dragged over " the pits"

donks

ps.... forgot they can write you up for excessive smoke

And so he should be defected for not having the gear stick clearly marked.
Not always a great supporter of the way some police officers act, but this is a safety issue.

Example: A couple of years ago I was following a vehicle that swerved off a small bridge. Car was perched in a bad position hanging over a couple of metres drop. Driver only partly conscious - not able to help himself. Before pulling him from the vehicle, we made sure the key was removed, the handbrake was on, and car put in reverse, just in case it moved while we were climbing in to help.

With some of the more exotic cars that are everywhere - not only the grey imports, but all the new high powered fancy foreign cars, you'd have no idea where to find reverse, first, or even know if there's 3, 4, or 6 gears for that matter, without looking for some markings on the gearshift.

Good on the police for doing their job properly.

As others have said, the drivers attitude can play a large part in the police officers attitude as well.

I'd say old constable plod found your workmate to be a bit cheeky. In WA it was standard police practice to place canary's according to your attitude. A neat, vertically positioned sticker in the corner was code to the inspectors to let the vehicle pass, but a sideways placement in the centre meant crucify the owner as he's a lippy bugger.

Some offenders got smart and steamed them off and repositioned them. The cops got smarter, noted the position and booked them for removing them without authority and added it to their list of woes.

If you're young, they'll do you anyway whether it's right or wrong. No shortage of frustrated nazi's among the ranks of our finest, but in all honesty there are many, many more good ones these days. The thugs are slowly being weeded out I believe.

A few years ago whilst i was living in Port Lincoln i owned an 69 Chev Comaro , well this paticular weekend it was the local Tunarama Festival, at that time of the year due to the increased influx of tourist the local police used to bring extra officers over from Adelaide .....i was just cruising around checking out the scenery when i decided i needed some fuel in the car ...i had just pulled up at the pump at my local garage when i heard a blast from a horn , turned around and sure enough theres a cop car pulled in behind me, i didnt take any notice just continued on with what i was doing when all of a sudden this cop walks up and says im going to check your car for defects , i asked him why ?? he says your wheels are out of track , so i say ok fair enough , but how do you know that?? his answer , i just know , well i said if you know that my wheels are out of track then surely you should be able to tell me the track measurements, i dont have to tell you jack bleep e he says...so i tell him im not going to let him put nothing on my car as its not on a public road and with that go into garage to pay for fuel , while im in there my mate who owns said garage asks me whats going on , after telling him he suggests i ring the local police station and ask to talk to the sarge and tell him whats happening , so i use his phone and do just that, after talking to the sarge he tells me that they dont infact have measurements for such car and to tell the officer just that ....so i do this and that was the end of that ...oh and Port Lincoln being the way it is the sarge actually knew my car ....not to many Chev Comaros in Lincoln......and that as far as he was concerned my wheels were fine ...anyway cops drive off and after having a laugh with my mate that owns garage , i drive off ....well guess what ...lol...i gets just down the road a bit when this cop car comes flying up behind me siren sounds and i pull over ....would you believe the bastards go right thru my car and only thing they could get me for was bloody battery clamp.....they werent local cops , they were from Adelaide ..........sorry for being bit long winded ........cheers .....Dave

I owed a A9X Torana up in Cairns, many years ago This use to stand out a like dogs balls. I had to watch everything I did on the road.
I was pulled over so many time for nothing. I'm sure they thought a car like that had to have something wrong with it. Most of the police thought I had modified the car. But it was standard. After a while the police got use to seeing it and left me alone.
I drove it to Townsville one time and in a single night got pulled over 4 times. They never got me for anything, just a total waste of time.

So I know what you mate is going through.

In the ACT they run regular blitzes on car regos & roadworthiness, you can have your car parked in a PUBLIC car park and come back to find a tag under your wipers saying that your car has been subjected to a roadwaorthy test in absentia and your car has passed/failed. Then they have the random roadside checks where everything is tested by the vehicle inspectors and police.
The Jackeroo failed one of these a few weeks back for having a copper exhaust extension, not because it was too long or stuck out too far but because it was copper. Something to do with the ADRs and vehicle emissions...I asked politley to see the relevant ADR and the PFT doing the test came back with the book and showed me. It is relevant for entire exhaust systems on petrol vehicles only...Quite humourous the enforcer read the doc too and agreed with me that there was no relevance to the TD Jack and it was only an extension...I was allowed to go but was of course given a reprimand and a breathtest....

Yessss... the police forces and "Authorities" have always been attractive occupations to those who feel the need to exercise power and control over others. There has been quite a lot of research in the psychological area, over the years, on this unhealthy propensity.
