Why the removal of Threads ?

Why are the 2 threads on the subject of someone loseing there franchise on a perticular suspension outlet removed from this site ???

If indeed there is a need to stop a thread couldnt you just lock it instead ?

Kev you might win the battle but you can loose the war.
Let's just say David made an executive decision, these things happen. An article was posted, someone took exception, David's caught in the cross fire, best we just leave it there.
This is a great forum, the best, and it functions on the integrity of it's users. The last thing David and Michelle want is to compromise the site so let's just respect their decision on this matter.

The website you have quoted is reg in Trinidad / Tobago for obvious legal reasons. I'm not sure of the legals when you in particular promote that site here, but I can't see the sense in testing the courts to prove a point over a stupid article, that may be amusing to some, but offensive to others. The article adds nothing to the integrity of this forum. I feel sorry for the poor bloke who may have a genuine gripe but it's his problem. Whose going to pay for Davids time if he gets hit with more solicitors threatening letters, are you ??
If you want to forward the article to your mates do it privately, not here.
Your comments about Diamond are also out of order, he's posted many worth while comments. He may be a rough Diamond but he's an Aussie with a good heart.

I've forgotten the actual people involved but there was a case recently about a defaming article written in an American website about an Auastralian. The legal argument centered around "where is the article deemed to be published, and therefore under whose laws may the defamation case be heard". In other words, was it published when it was uploaded to the site or when someone downloaded it. I think the person involved (Australian) succeded in having the case heard in Australia under Australian law (in Victoria).

I believe David is correct to remove defamitory or maliciously incorrect statements from this forum, and in fact has the legal right and obligation to do so. Let's not forget that it is Davids' website, in which he is the ultimate moderator, and has to weigh his legal responsibilities, commercial responsibilities, and the community atmosphere that he is trying to foster.

You People are unbelievable all the guy is asking for is your support no more if he was broken down in the bush I suppose you would just drive on by.As for legalities the site is registered in Germany not Trinidad and has been posted on hundreds of forums around Australia and oversea's what amuses me is that David think's the lawyers Gaden's will only target him I don't think so there the so call threats are empty they have no legal precedent's to rely on. And a court order would have to be made against the originator which won't happen for this to stop.Exploreoz is not the moral integrity for the majority only the minority.As for Diamond he makes comments that have no basis of truth in regards to the site owner in Feb 2003 in which he states the person in question is a sooky la la and has a bee in his bonnet because he had his franchise taken away over poor workmanship and poor service. Does he know the guy to make such comment's no he dosn't it just a guess on his part. I know the guy and everything he spealks is truth I know this because I have read the Accc submissions.The Person in question is gravely ill with a motor neuron disease and he is fighting a major corperation I think he has more guts and ball's than any off you pussey's in exploreoz.

I have no legal reason other than the fact that I find the content of the site offensive and so do many of my readers and members. I have only had to delete a few posts in the past however last week due to legal reason I delete an entire series related to a certain business that decided to try to threaten us. If I get a concern that a post may cause me an issue I will delete it.

I am sorry your mate has had a problem with Pedders that is fine however posting links to a site that contains swearing, rude pictures and legally defamatory comments is not what I want on my site.

Read our Terms of Use - I can and will delete anything that is offensive even if it is a link to something offensive.

As I am the author of that thread about "Overlander" magazine, I feel that you should go and read it again. At no time did I use ANY profanity, attack anyone personally by name, and I ensured that my statements were backed up by exerpts from their own magazine (except my mistaken comments aboutthe 4X4OTY). I was critical of the overall editorial direction, NOT OF THE EDITOR PERSONALLY or the sub-editorial staff (despite the use of the colloquialism "do a bit of editorial headkicking"). It was all good natured, spirited discussion.
