Caravan water leaks

Dont know if any one can help but just brought a brand new Montana caravan 4 weeks ago and after first week had bad water leaks through front windows. Took it back to dealer who after a week said all fix then back home we had heavy rain (Gold coast) and leaked again and I discovered it was coming in through one of the outside 12 volt lights which was not sealed,. Now there is water damage and water stains to the interior wall lineing which means that there is damage to the internal ply. Now back at the dealers who say that they are now going to replace the rear internal ply and the 2 front windows. I told them that I wanted another van as it being only 4 weeks old and they where aware of the problem after one week felt it should be replaced. Told me that they would not do that but only repair the damage. What I am trying to find out is what are my rights regarding this. Should I force the issue or are they in the right?

You will find that in general the supplier has a few chances to effect repairs to the goods you have purchsed and usually do not have to replace the whole product if they feel repairing part of it will solve the problem.

Hi Mozeve, Whilst this is a great site and very informative, I think you would be better off seeking advice from a solicitor or the state consumer protection authority in regard to your problem. Others on the site may give you feedback on problems they may have had with new vans and the outcomes.

But if I can just leave you with a couple of things,,,...don't let this rule your life... find someone else to worry about it ....just keep records of all happenings...file them away and don't leave them sitting there in front of you and your family.
Looks like you got a lemon right now ....but I hope it smells sweet for you soon

you will find none of the windows, boot lid or door will be sealed properly. Unless they are all sealed with butyl mastic they will always leak. they use foam tape which will never seal. Look at quality built vans and you will windows are sealed with proper sealant ALL the way round and not a dab across the top.
Will need to be a good repairer to see the panel has not been replaced. This is what happens when you buy cheap construction vans like Montana and Majestic they cut corners and never do things properly. People dont get advice prior to spending so much money.

I would get in contact with the department of fair trading as ,company policy is and the Australian law are OFTEN 2 different things

i have had items sent to me that have been DOA - there company policys stated that i have to pay for shipping back to them and wait for repairs

Once i contacted DFT and informed them of there obligations - there was no further argument

Better to be fully INFORMED and not just put up with a company saying " This is how we do it "

Sorry to here about your problems with the Van, what sort of warranty did they offer when you purchased the van? the minimum should be 12 months, the suppliers do have the right to make all attemps to rectify the faults, before asking to replace with another, I have seen vans repaired after major damage and in most cases you couldn't tell that they were damaged at all, it appears that your van has slipped through the inspection process, I know with our make of van they have a very stringent inspection criteria, and they virtually flood the vans to test for leakage ect, also the same for dust, give them the chance to make good before taking more drastic action, I know you expect that when you pay good money you shouldn't have to put up with this problem and also the inconvenience of interrupting your travel plans, when it's all fixed in the end I hope you enjoy your caravaning life style, ignore the replys about lemons and cheap and nasty stuff, I have heard of $100k vans with similar problems.
