hire cars and insurance repairs

yesterday my sons car hit a cement truck that pulled out on him at 07:00 in very light traffic with my son in the right hand lane of a dual carriageway. thankfully, no injuries.
case closed as far as whose to blame.
question 1 - who is going to suffer? answer - my son
cement driver gets into another truck today having driven to work in his car.
my son has no car for probably 2 weeks and has to get from leederville to canning vale and back every day.(very difficult if you know perth)
insurance says there is no provision for him getting a hire car.
if he wants to, he can hire one and present the bill to their insurance and 'maybe' get refunded.
question 2 - has anyone been successful at claiming in this situation?

Nope unsuccessful, though i suspected that to be the case. Unless your insurance policy specifically covers a hire vehicle, then i don't like your chances, even if someone elses fault. It seems only the premium coverages allow for hire vehicles etc, however you normally pay for it in the premiums.

If he needs a car, just do it, then maybe you will get a refund. If not, then at least he has a vehicle, albeit costly.

Thankfully he's ok. I witnessed a b-double Cement Truck (carrying cement not concrete) deliberately swerve in front of a vehicle in a fit of road rage and squash the front of the vehicle at the Tugan traffic lights. Makes a mess of the vehicle, with not one scratch on the truck!

I guess it depends on the insurance, we had another driver at fault run into the rear of the little iO a number of years ago. Took it in to be fixed, was told we would get a replacement vehicle during the repair time. I said OK. Got a phone call from a hire company that specialises in providing this type of replacement service, to say that unfortunately they couldn't supply a 4wd, but would a mercedes be OK?

if you pay the extra to allow you to get a hire car you can expect one, if you dont pay the extra, I dont really think you should expect oen.

i don't read small print like most of us, i have never been offered a 'hire car option', and it doesn't rear it's head until you have an accident.
it would be good if, for the sake of a weeks hire at around $150, as opposed to the thousands that this repair is going to cost, that a hire car for the victim would, and should be made standard.

its always one of the options like Windscreen cover and paying extra to save your NCB.

agree that there is too much bullshti in insurance company paperwork..

Our Wesfarmers ins provides it free if you are AAA, we got a Patrol for 5 days from them (max $500)
It was then I decided I didnt like 3.0 patrols!

You should ask your insurance company if they will include it in their claim against the truck for reimbursement by other company, even though it is your bill.
If they say "no" even though there is no risk to them, go looking for a better company. They should though as when they settle it will be for full and final amount and you probably have no recourse to claim against him individually.

Unfortunately there is no "victim" until someone admits fault or a court does it.

But as Truck says, you dont get anything for nothing, take the option or take the risk unfortunately

My trusty 03 hilux was reversed into by a truck (The blokes that lay the concrete)on the site I am working on at the moment. My Insurance would not give me a another ute and they also said they were not going to replace the parts with genuine Toyota parts even though it was still under warranty. $10 000 worth of repairs needed
I was given a phone number of a company here that would supply me a work ute and claim it of the trucks insurance company. I had to write a letter stating I require my ute for work and by not having the ute my business was suffering. OK it took two weeks before I got the claim number from their insurer but as soon as I did I got the ute. (No expense to me. Only a credit card number for deposit).
I insisted the hilux was still under warranty so they must put in genuine parts and finally had a win. I pick the Hilux up in a 1 and 1/2 weeks.
I seem to recall somewhere in the paperwork that if it you were having diffuculties with public transport then u must be able to prove that and then they will pay for a hire car.
I too said to the company "Why should I be punished for their drivers negligence"

I was and had the same experience plus a bit more.

Changed to GIO and recently SWMBIO backed into some dude in a shopping carpark. Totally her fault.

GIO had it all organised within 3 hrs of ringing - reparier of my choice, new part/s and hire car that I didn't know was included in in the policy.

Actually insisted that I have a hire car.

I am with gio/suncorp and they did not want a bar of me...... My repairer helped me along. I did all the organising myself

Was it a full comprehensive policy or some tricked up commercial usuage thing.

Some repairers will provide a courtesy car whilst yours is being repaired. If you can choose your own repairer it may be worth looking into.

Yep, have claimed the cost of a rental car and lost wages on the other "at fault" parties insurance. Got hit in the rear, took 6 weeks to get in to my choice of repairer so I billed the other insurance company and got it. lack of car caused 3 days loss of work, got supporting documentation and billed them for lost wages and got it. Once car got in to the repair shop, turned in the rental and then used the repairers loan car.

After reading this thread I think the moral of the story is to stay away from any vehicles that have anything to do with ' concrete/cement ' :-)))

I was looking into the hire car option myself since my truck got hit and is off the road for one week already and looking at another one to two weeks. To have a hire car on your insurance you have to pay a little extra each month for it, Which is what I have been doing.. but won't be any longer... you still have to front up the $400.00 bond, and they have two excesses, one was $650.00 and the other was $2200.00! but you could avoid those two excesses if you chose to pay an extra $28.00 a day on top of the hire cost.....(insurance covered no deposit, they would only pay up to $40 a day for the hire of the car only).
What a joke!
