want to change tow hitch on my mates van, it has 3500kg stamped on it but it has a max load of 1600kg axle load. he has a hyland hitch rated at 2000kg, can this be used and if so will it be legal?

Can't give you an answer only to say it may be worth a call to the van manufacturer and see what they have to say.
