"In a move that could set a nasty precedent for Australian website operators and their users, a software firm is suing a community website over comments published on its message board."

Firm sues forum to silence critics - SMH

The outcome of this case may have some interesting ramifications for sites such as Exploroz. Particularly noting the number of 'product reviews' that tend to happen on here.

It would be a pity to see the critics silenced in my opinion.

Matt.

Without knowing the intimates of the case I think it's fair play. Whirlpool is used by thousands like this site to discuss the pro's and cons of various providers and services. I don't think anybody should make defamatory comments re another company if unproven.?

Having said that I think the users of this forum have been very kind to products like the Fitch and nobody has been sued yet..!

But yes a precedent set in this case could well effect forums like this one..!

OK, Nissan 3.0L Patrol Diesels don't blow up and the Fitch really does work..! Safe now.. Hey.?

Mind you facts are facts, if something is factually correct then there is little to be concerned about...offering opinions on a company, product or service that can be proved to be factually incorrect is another matter.

I don't see any problem with making comments good or bad about a product, Choice Magazine does , I do accept if the comments are untruths then the commenter should maybe take a rap, On the other hand if the comment is true and one can back up the claim then there should not be a problem, let the issue take it's course.
I guess Uniden and Navman will be after my scalp , well I say let the show begin.

I think they tend to loose sight of, IMHO. In my humble opinion, X is good and Y is bad and these are my personal experiences with Z.
What harm can that do?

Actually, I recall David had to pull a posting on this forum some time ago after legal threats over comments about a certain diesel service company in country NSW.

He has also added a program to not allow the said business or location to be able to be mentioned.

Basically this is a non-issue Matt , and I expect nothing will come of it , if as is reported.

No one should have any fears about voicing there opinion in a reasonable way.

Several times scares like this have come and gone - remember once soon 5 years ago now when some people got very skittish about trips being organized on sites.

In this case I refer to my comments, from when I was providing advice to one of our largest consumer electronics companies and then specifically on out_of_melbourne forum and 7 years later the fears remain a non-event.

More of a worry is that virtually anything you say here on ExplorOz Forum gets picked but by the webcrawlers etc and can appear on Google when you are searching for something entirely different.
