2007 Patrol - shot clutch

Guys Hii, I'm new here and seeking some advice. I got a Patrol with 3000kms on the clock and then racked up another 900kms before the clucth shot out whilst we were off road. Clutch is trashed and so is the fly wheel. I consider myself to have reasonable 4wd experience having served in a number of theatres for the Uk forces before coming to OZ. Essentially after 8-10 mins off road we were getting into softer sand so attempted to shift to 4L but lever wouldnt budge, tried moving car back and forwards and still lever wouldnt budge not even back into 2H. As we were extracating ourselves back to the tarmac clutch burnt out and failed. Had to be recovered by contracted 4wd specialist who took 40 mins to get car out of 4H and into neutral and claimed they had never seen anything like this before. Nissan are refusing to pay as do not consider it a manufacturers defect - understandable as its a burnt out clucth, but my issue with them is the ratio selector wouldnt move out of 4H causing clutch to burn out. Nissan dealership have had car to pieces and back together and it 'now' operates correctly. Have quizzed dealership who categorically say car has never been in 4wd at any time during first 300kms - odd thought it would have been road tested and in all modes prior to delivery as stated on PDI - they also say they have never seen a clutch in the same state as mine. Not sure where to go from here - had I fried the clutch through being an ass and having got bogged I would pay up but we were still rolling and there is a principle at stake here.

You'll have a battle with Nissan. Perserverance is the key and talk to Val Davies as she seems to be the only compassionate person at Nissan. I think the number is 03 97974111.

Send the story to Graham Smith who publishes these things in Fridays Herald/Sun motor section. That may help and it'll shame Nissan some more! His e-mail grah.smith@bigpond.com.

Sorry to hear that happen to such a new vehicle.

Just for the benefit of others, if you are in a situation where "transmission windup" prevents you from shifting the lever, then jacking up one of the wheels will "unwind" it.

I'm not saying it was 100% of your problem, but is certainly worth doing.

Clutches are like brake rotors not covered because they are consumables however keep pushing. I had rotors that wore to under thickness in 40000km and got the same story. I went to fair trading and they advised that one can expect resonable service out of these type of items so I pushed hard and they came to the party for supply of new parts with a token labour fee.
The same I reckon would apply to your clutch it is not reasonable service that would be expected so talk the bulls**t to them and keep pushing hard I reckon your in the right. Like they said persistence is the key. they hope that most people will just let it go.

Ummm, presumably you know that ya need to push _down_ on the lever against a spring detent to get into (and out of) low range.....
Were you doing that?

If so, then it would appear you may have a selector problem:(

If not, then I'd class it as operator error, and an expensive lesson (not a warranty issue)...

Yep, I was doing that so does sound like a selector issue as we moved back and forwards to unwind the drive as well.

Sorry to hear about your clutch problem. Hopefully you can get Nissan to 'come to the party' re expenses. Re your comment on PDI (gather you mean Pre Delivery Inspection) it is often referred to as an 'expensive car wash' and little if any mechanical inspection is carried out. Dealers/manufacturers these days rely on customers to conduct the PDI for them which is why some manufacturers offer a 'free' 3,000 km 'check' - it enables them to perform any repairs/adjustments that you might have reported to them. Regards the payment of Pre Delivery Fee, anyone silly enough to pay that deserves 'what they get' - usually NOTHING in return. It is nothing more than a rip-off and the sooner consumers realise this and tell dealers what they can do with their demand for such payment, the sooner everyone will start getting a fairer deal.

My nephew had similar problem. As soon as he hit the beach (100m) the vehicle failed to move without manual pushing. Managed to get it straight back to the dealer under its own power under advise from that dealer. They advised if it dives then drive it back. So with less than 100Klm on the clock the clutch was st***d. The vehicle was repaired but the dealer would not let it out of the shop until over $3000 was paid because, wait for it, "this vehicle is not designed to be used in low range off road so not covered under warranty." The old clutch was not available as it had been "disposed of".

I am amazed in this day and age there still pulling the old ..........Sorry the broken parts have been disposed of ....I think all you nissan owners should when going to the repair shop have someone record all conversations with a video recorder...........that way you have them on tape.

There is of course the power of the internet let everyone know there scumbags.

RESULT!!!!!!!!!!!!

I spoke with Val Davies this morning and explained the situation, I had a phone call 15 minutes later from the dealership and I just had to pay for the clutch peripherals ($600 ish) everything else got covered under warranty so thank you so much to AJB for that gem, and thank you to all of you for your help and advice!!!
