After considering all the options I decided to hand the complaint over to the Office of Fair Trading who are dealing with it in a totally professional manner, they have arranged to have it analysed by an outfit called TriMas who are located in Victoria, now here's the rub, TriMas have requested me to take the tongue back to Repco so they in turn can forward it down to TriMas for analysis... Oh the irony of it all!!! Ya gotta laugh.
The ball is now
well & truly rolling, I will update as the info comes in.
Cheers 2TGs.

It would interesting to find know what their findings are.

Hi 2TGs,
I would make sure you have plenty of photos of the damage and get a signed receipt for the tongue preferably with a witness. Just in case! I took a damaged tyre back to one of Australia's bigger tyre merchants mid last year to get a warranty replacement. They lost it and nobody could remember anything about it, how convenient. When I bought tyres for my Jack earlier this year no prize for guessing which mob didn't get a look in.

Why do they request the offending item to be sent via the retailer??
Seems a little strange to me.

Hi John.
Mushrooms mate!!! Keep you in the dark. feed you b/s etc is my guess. When I was contacted by the chap from TriMas he said he was representing Hayman Reese, my rat detector screen immediately lit up so I went back to the rep from Fair trading, she then tells me that she had requested TriMas to do the testing, also adding that if I wasn't willing to to take the said item back to Repco I would have to have the analysis completed locally at MY EXPENSE!!!... To achieve an outcome. She also implied!!!That I should have known all this... So much for trust & the passage of info...
A lesson I learnt long ago but must have temporarily forgotten... Never ever assume your Government is on your side, they will screw your guts out & then come back for the bones if it suits their agenda, so at this stage all I can do is document every thing with photos etc & hope for a positive outcome. Bottom line is John if it all goes down the shi*er I can walk away with a clear conscience.
Regards 2TGs.

2TG's, not sticking up for anyone here, but as a manufacturer that sells a product nationally through various distributors, including Repco, our standard warranty procedure is this.
1. Customer returns product to supplier for exchange / refund
2. Offending part(s) is sent back to us for evaluation (at suppliers cost)
3. If part is defective due to workmanship or materials a replacement part or monetary credit is issued to supplier. If materials, we wear it. If workmanship, a Non-conformance certificate is logged. If damage is caused by misuse or a use other than that which the product is intended for, no warranty claim will be honoured.
4. If we see the need to have an independent review of the component done we will instigate that at our cost. If it is found that the product has a defect we would set in place corrective action procedures and processes.
However, we would accept warranty claims direct from the purchaser, but only if accompanied by all of the appropriate documentation, and all warranty issues have been met.
In the past 12 months there have been a couple of incidents involving our product. In each case, because of absolute stupidity on the part of the person using the product, that defies logic, we are now forced to review the risk assessment on our product, and potentially, make changes to our documentation and even the product, and notify everyone that sells them so they can notify people at Point of Sale. Were being expected to do things akin to Holden putting a sticker on the dash of their vehicles saying "CAUTION - do not drive this vehicle off a bridge", and then issuing stickers to everyone that's ever bought a Holden.
Don't be too harsh on your retailer, except if they don't give you a good response. I would be contacting Repco head office direct. I think they are in Mulgrave from memory.
Hope this of value.
Louie

In the meantime, these things continue to be sold/offered for sale, and it appears that nobody (least of all the manufacturer) is in the slightest bit concerned about the potential consequences!
The way I see it, Repco are not at fault here...
Hayman Reese should have been falling over themselves getting hold of the defective unit and taking steps to ensure that no more are sold to the unsuspecting public until the fault is identified and
well and truly rectified!
After a caravan has broken away from the towing vehicle and smashed into some unfortunate family heading in the opposite direction, will be too bl@@dy late, Mr Hayman bl@@dy Reese!!
Stick to yer guns Tommy...
