I have just received a refund from this trader - they were advised that the products they supplied to me were not of 'merchantable quality'
well before the 3 August - there were several emails backwards and forwards before I sent that Letter of Demand.
I sent a copy of the Letter of Demand posted on this
forum (60440) to the NSW agency responsible for consumer affairs as
well as to Glowplugs Australia - they contacted the owner and he made an 'offer' which I accepted.
There are a few facts (assertions provable by evidence) that can be stated here:
the products were not of merchantable quality (in the vernacular they were "rubbish");
when advised that products they had sold me were faulty the trader chose to prevaricate and obfuscate rather than apologise and immediately refund;
the threat of recourse to a legal remedy forced them to give me at least some of my money back;
they use the difficulties of launching an action in a State different to the domicile of the trader to 'negotiate' a settlement;
dealing with Glowplugs Australia has cost me money-that is-I am out of pocket through no fault of my own.
Those that posted the unhelpful and ignorant comments in Thread 60440 can choose to support Glowplugs Australia if they choose-just buy his Glowplugs and fit them to all the diesel vehicles that you use to conduct your businesses!
Others not so philosophically opposed to using consumer protection laws to 'curb the excesses of the heartless' may want to consider other sources of supply.

Good on you George for following it through!! Most people are happy what is promised and fair. Some seem to take advantage of the weak, fortunately not this time.. regards Michael

Often one cannot get appropriate recourse George at least you are part way to recompense.
