Anyone had personal experience with NRMA or SGIC car insurance in relation to "Improper vehicle use"? Specifically the statement in their PDS "we will refuse any claim" if you were "engaged in a wilful or reckless act while driving the vehicle". For example did they consider crossing Nolans Brook on the OTL - Cape York or a beach creek crossing etc, etc to be a "wilful or reckless act" and refuse the claim?

In the normal course of a day many people cross Nolans Brook and many other places and if there was a claim arising from crossing the creek it is unlikely it would be refused on an ‘improper use’ clause. I even venture to suggest this would be the case even if the creek was surging and it wasn’t sensible to cross as it might be argued it was poor judgement, but not a wilful act.

But if you were street racing or something along those lines than that would most likely be viewed as a wilful act. Going down ‘gun shot’ with a trailer might find you having to defend yourself that it wasn’t a ‘reckless act’. I’ve seen a video of this very thing where the vehicle was damaged. Hard to classify something like that as ‘not sensible’ because it was clearly ‘reckless’ the evidence was on you-tube to prove that point!

Remember an accident is just that, and that is what you are getting covered for. My tip is use your vehicle for what it is intended for, drive sensibly and with common sense and it is unlikely this clause will ever be a concern to you. Either way, good luck finding a policy that doesn’t have it in it.

I'm one of those who crosses Nolans Brook etc and don't consider the way I do it to be "reckless". We currently have insurance that covers us in this situation. Am in the process of changing our house & contents insurance to SGIC. Was thinking of swapping our vehicle insurance to SGIC as well but their "reckless act" comment bothers me. They said their loss assessors where reasonable people and I have no reason to doubt them but I guess I was hoping to find someone who has had the misfortune to have to make a claim with them (or NRMA) under these circumstances to see how the claim went.

I was concerned about some of the aspects of my NRMA insurance, particularly regarding off road driving and emailed the company for clarification. To their credit they emailed (now in writing) back and and answered all my questions and now I am confident when I go off road. But as mentioned no competitions.
I also recently needed to change the windscreen on our other car also with NRMA and glass cover. It took just 5 minutes on the phone and a guy turned up 2 days later and new windscreen, no cost, no loss of NCB. Not like some other insurance companies I have dealt with, but someone out there will have a different story

NRMA was in their opinion, were one of only a handful of companies that fully insured to go off road. Yes the free windscreen is correct but they wanted $1300 to insure my Patrol.. GIO was half that price... 60% lifetime discount..they can keep their free windscreen...Michael

Another vote for NRMA. I claimed a few years back after clipping a tree in a very very hairy off road rocky climb, wheels spinning and bouncing about, you know the one. When questioned i simply named the road 'track' i was on (all checkout out on google/whereis) and said at fault, single car collision. No more questions asked. Even got my side steps replaced.
