my mate is trying to buy a caravan, he has found the one he likes and paid a deposit on it . that was three weeks ago, to be picked up on the 28th. went in on the 28th, van not ready, bloke said i had a lot of other things to do sorry pick it up Monday. went back today and van still not ready, bloke then said pay for van in full and will have it ready tomorrow. mate said no, i have the money and will pay in full when its ready. bloke shrubs his shoulders and says i will call you when it ready, mate asks when will that be. bloke said when its ready its ready and walks off. this is a brand new van and $50.000 Worth and from a dealer. you just cant believe some people.

Tell your mate to ask for his deposit back.
Surely he still doesn't want to buy something that expensive off such a jerk.
The jerk cannot refuse. He has "broken" his contract (delivery) twice.

name and shame the dealer. contact the maker of the van and let them know how the dealer is treating people, and if they dont care, go elsewhere.

Where is the dealer ?
I have a Lotus and have had nothing but help from my dealer whenever I have had a question and the actual placing of the order and the delivery was excellent. Van was delivered on time and the warranty backup has been excellent.
There are only a handfull of dealers around. There is one in South
Tweed Heads, anohter on the Sunshine Coast, another in
Sydney, one in Wagga, one in
Melbourne and I think one in South Oz.
Would be really handy to know where this dealer is. Hopefully it wasnt
mine.

i have to be cautious here as this is what i have been told by my mate, but have not known him to bulls#$t. and as south Australians we try and do the right thing. so will refrain from naming the dealer for now. this is a demo van, he did not want one made as he thought the demo would be finished of better.

I appreciate the position you are in.
Thank God it isnt my dealer. I would have been very suprised if it was.
Tell your friend to ask for George at Lotus and if he isnt there, ask for Robert, but George is really the one he needs to talk to.
Maybe he needs to go to
Melbourne if he has no success with the rouge dealer.

Would be telling him to give deposit back or you are going to bad mouth his dealership all over every web site possible and stand out the front with a huge plackard telling all future clientel how he treats customers. I had to use this threat and it worked, got a complete new camper sent to me and this company was in SA I'm in NSW dont back down from assholes like this. How much deposit did he leave if only couple hundred I'd still do what I did just for satisfaction. He told me he have me in court for bad mouthing his bussiness I just said go for it he backed down real quick.I had all the photos and everthing required and had my sister ring him up pretending to be my solicitor she's got one of those real proffesional phone voices.Done the trick. I didnt end up bad mouthing his company as he come good and sent me what I asked for buy boy if he didnt I was ready.Told him I would hook up the camper to the hilux and drive it over to SA and drive it through his show room plate glass window camper and hilux. Trouble is this appears to be a very common problem with van dealers. We had the same issue. Left our trade in ($20,000 worth) with the dealer on a $66000 van. Was to be ready in May, then June - finally got it mid July just 1 week before we headed off for a month in Victoria. Had one weekend to practice setting up etc. before covering 6000km. Came back with a list of 20 faults. Got most of them repaired, others were minor so fixed them myself.
The caravan industry doesn't have a particularly good reputation as far as quality and service goes

We get what we ask for in this life and sadly some folk take shyte like that laying down. Stand up to these jerks if they want your money. If enough people do that then they change or go out of business.
Be fair and firm with them, if that's not enough, make life hard for them.
Threaten to take the issue to Dept of Fair Trading or whatever it is in your state, it does work in most cases, but you have to have tried to resolve it yourself on at least two occasions, then involve them on the third. Keep records of all your dealings and try to talk to them via E-mail etc, this is perfect evidence in court.
Colin
PS a resolution can take 2-?? weeks but mostly the lesser in my experience.

Was just reading further on you say it is an ex demo so should definately be no reasons why he cant refund you. As said above he has broken his part of the contract and it was not a special order just one sitting in the yard. Do as mentioned above and keep records of all phone calls, times, dates etc and send him emails requesting refund. You will also have to send him a letter in writing requesting refund this is how the fair trading in NSW want it done and they have 7 days to reply to you.
This is the letter I sent just to give you an idea of what the fair trading wanted me to do ---------------------------------------------------------------------------------------
Dear Mr xxxxx
Under the Consumer Transactions Act, I Stephen Miller, am requesting a full refund in the amount $ xxxxx I am also requesting that you take repossession of the Camper Trailer at your own expense.
You are required to respond in writing to my request within 7 days of the date of this letter. If you do not respond, this will result in further action being taken by the Department of Fair Trading.
Regards,
Mr Stephen Miller Witness Name:_______________
Witness Signature:___________________
They called me the same day they got this letter and offered me a brand new one I agreed to there offer as I really wanted it BUT your talking a huge amount of money myn was only 7g all up just under actually. Go em but do it the right way. You have proved that so far by not displaying there company details. I know it would be hard for him to not want to tell everyone but you need to start off the correct way or he could get himself in trouble. If all else fails then bagg the bleep out of them.Depending on the deposit left it might be worth walking away from Regards Steve M

All thats been said is true, in the past I've taken 2 companies to small claims and won both cases, I also dont have any qualms about naming companies who give bad service,if thats what they did they deserve it, so come on mate if not for you think of others who might fall into the same scenario,
regards,
Dave

As a Lotus owner, I am curious how the person in question got on today if they fronted the dealer or rang Lotus direct.
Can the original poster (chips59) please post a follow up to this story.
Thanks,
Cruiser

not much to add, rang lotus today and spoke to Robert.
he said that he would speak to the dealer and see whats going on but did say that the van is a demo model and as that is the last one he has he may be stalling him as he (the dealer) will not have anything to show other customers. but he is still able to sell it if he wants. my mate is going back tomorrow to see if they can work something out, if not will try and get his deposit back.
